US Supreme Court Narrows the Definition of Waters of the US

A ruling that limits federal jurisdiction over certain wetlands.

Wetlands subject to Waters of the United States jurisdiction

In a resolution of longstanding legal battles over the definition of Waters of the United States (WOTUS), the U.S. Supreme Court ruled on May 25, 2023 that a regulated wetland must have a "continuous surface connection" to bodies that are "Waters of the United States in their own right."

The full ruling, Sackett v. EPA, is available on the U.S. Supreme Court's website.
